Can my company force me to work overtime in a different depot, in another location two hours away from my depot on my day off. After working my 40 hours work week on my day off I am being forced to drive two hours to another depot to work a 10 hour shift of mandatory overtime. my company is will to pay mileage. I was not hired at this location so I fill that I should not have to drive there to work or work at this location at all. My boss is threatening termination if I do not.
Indiana is an at-will employment state, which means you can be terminated at any timed, for any reason (or even no reason at all), and without notice. A corollary of that is that your employer may assign you to do any work, at any location. The only requirement your employer has is that you must be paid overtime, at one and a half times your regular rate, for every hour you work in excess of 40 hours per week.
Additionally, the two hours driving time to and from the second location is NOT work time, and you need not be paid for that. Even though your employer is going to pay you mileage, he is not required to do so.
The bottom line is that, if you refuse to work as instructed, you CAN be terminated.
