There was no home owners association formed when we purchased our home. One recently formed. We did not sign up or pay dues in February. They are now sending us a late notice with a threat of litigation if we don’t pay the HOA fees. Their was apparently an HOA by law that said once 75% of the property’s where sold an HOA would be formed. I was not aware that I would or could be forced to join it once it had formed.
Please contact your closing attorney. However, if you purchased a piece of property that is subject to a recorded Subdivision Declaration that contains that you will be part of the HOA as an owner of a lot, then yes you are a member of the HOA and are subject to any assessments for fees.
