I am 19 years old, and I with a 16 year old male, can i be charged even though age of consent is 16 in Georgia? It was a mistake, i'm aware, just wanting to know if i can face those charges?
Probably not statutory rape, but other charges could arise, so best to lawyer up now.
I am an attorney, practicing throughout the state of Georgia, in the areas around Augusta, Statesboro and Savannah, Georgia. The information I am providing you should only be considered for your general knowledge and educational purposes, but not as legal advice. Consider it as a good first step in your knowledge acquisition, but not as legal advice. My opinion should be understood to apply only to the laws of the State of Georgia. You should always consult with a local attorney about your situation if you live outside of the State of Georgia.
No, you can't be charged with statutory rape. However, that won't prevent the 16 year old from claiming you used force or some kind of coercion to rape him. There are usually some kind of rape or sexual assault charges when one of the parties decides the sexual encounter was a "mistake" after the fact.

Statutory rape is not possible based on the ages you described. There could be other potential crimes depending on the sexual activity engaged in and the willingness of the parties. Your partner is a minor, so be careful what you discuss in open forums.
