I am trying to help get simple assault charges dismissed against my boyfriend after he decided not to plea guilty and take it to trial. I understand that if he is found guilty at trial he could get max sentence which he plans to appeal. This could drag on for years. I am concerned however that i could now face charges for trying to get it dropped. Also. Can my therapist exempt me from court? I just had perjury comitted against me and know that i will not be able to handle sitting in court and having a lawyer say that i am lieing.
Advocating for or expressing a desire that the charges be dismissed is not obstructing nor a crime. If you are subpoenaed to court, you could potentially be held in contempt for refusal to testify or if you ignore the subpoena. A therapist cannot write you a note excusing you from testifying. The closest you'd be able to get would probably be if you were somehow deemed not competent to testify, but that would require hearings concerning you before the judge and with both sides (State and defense) free to question you.
