Just last year I agreed to allow my child's fathers to claim one of our children. We have a parenting plan and a child support order where he is due to pay us monthly. He decided in November he was going to let the money rack up and not pay until after he gets his taxes. So we will have to wait until he gets his taxes for any of the backpay. So basically saying he's going to make us wait months and not pay anything and use our child to get more on his taxes and pay it off that way. Would a judge allow this. We had the worst Christmas and are owed almost 2000. Would I be able to fix this so he can't do this to us after I already agreed he could claim one of the kids?
In order for you to be able to claim the child exemption that was awarded to your ex, you must go back to court and modify your Judgment. While you are at it, add a second Count to your petition and ask the court to hold your ex in contempt for not paying you monthly as required.
