I am a mother of two children who was married for 7 years, during the 7 years there were a lot of domestic violence, he was arrested but I never pressed charges. Since 2017 we have been back and forth to court because he is not following the order, the first year the judge ordered supervised visits he did it once and this second years about 8 times. He has not called the children since last year August and sees them when he feels convenient. He has family everywhere I only have family in Florida and Georgia. Can I ask for full or sole custody and relocation and he can make arrangements with me to see them when he is in town? My kids don’t want to be in California, they are 3 and 5. I am planning in going back to NC where they were born because the cost of living is cheaper and it’s closer to family, and we’ll have a better support system. He is not consistent with anything, he has remarried and had another baby and her two children and i don’t care, but he has his family and a new family and it’s just me and my children. No aunt, uncle, grandma or nothing around. I am a full time mom, student, and I work full time. All the responsibility is already on me. I did go to county for CS.
You can certainly make the request in a Request for Order for Move-away but be sure an emphasize that you will make your best efforts to promote a continuing relationship with the father.
