As long as you are in the United States legally, such as on an H-1B, you can apply for adjustment of status when your priority date becomes current.
The guidance and/or advice provided herein does not create an attorney-client relationship and is for general informative purposes only, One should only take action after retaining an immigration attorney.
Generally, yes, if you were admitted to the US and continue to maintain legal non-immigrant status, remain eligible to adjust status, don't have any issues that would make you inadmissible and file according to a valid I130 that has current priority date. You could work with an immigration attorney to ensure that you are eligible and file correctly.
if you maintain status until the adjustment of status application is filed
