I filed a petition in Queens Ny family court to vacate a child support order that has been dragging for over 17 yrs cause my child's mother disappeared with my son and is nowhere to be found.I no longer live in NYC and have had 3 hearings by phone with a court magistrate who decided to revoke my petition today for the lack of serving the papers to my sons mother.On my last hearing date the magistrate demanded that i contact the sheriffs department to serve the petition to her last known address and i did exactly so.
The sheriffs office has presented the proof to the court that an attempt was made to serve her and was unsuccessful and the magistrate is claiming that the court has no proof of the sheriffs process service and suggested i file a new petition all over again.I am unable to travel back to NYC and would like to resolve this complicated matter for once & for all.
