I have been in US since 1984, currently have a Withholding of Removal Status. My son was born in US & is a Citizen. He is 21. Can I adjust my status through him (can he apply for me to become a US Resident)?
Generally speaking, a 21-year-old U.S. citizen can petition for his father to become a lawful permanent resident, even if the father has an order of removal (including an order of removal with an accompanying withholding grant protecting against the actual removal to a specific country). However, it may be necessary to seek reopening of the removal proceedings before the adjustment application can be adjudicated, which can be an uphill battle and may not be advisable for a number of reasons.
