My sons father and I were together when he was born, but have never been married. I gave my son his fathers last name. His father continuously asks to get him on certain weekends, and then just doesn't show up, and won't answer calls afterwards, and won't contact me until a couple weeks later when he's ready to do it again. I'm sick of my son being faced with the let repeated let downs. His father does pay child support though. There is NO legal custodial agreement, but being that he was born to an unmarried mother, custody is solely mine, right??
An unmarried mother is the sole legal custodian of the child until a court says otherwise. Changing a child's last name is accomplished through probate court, but you would likely have to give notice to the father. The father would then have the right to object.
