My HR at my job asked me to bring in a note from my or hospital to return to work cause I called off Sunday I didn’t go in until Monday I faxed her the paperwork she called the hospital and they gave her my information and even told here y I was there and she fired me because I didn’t go in on Sunday I was in so much pain I wanted to sleep it away n I couldn’t so I finally went in so can the hospital release that information to her and can she just call the hospital to get this information with out my permission and who do I call for this
The hospital probably should not have released your information without a written authorization from you signed by you permitting the employer to have access to that information. The problem is that the HIPPA statute is horrible in relation to the penalty that attaches for a violation of the act. Basically I believe its a $100 fine for each violation, which they won't voluntarily pay, so you have to hire an attorney who won't work for free. You can probably call hospital and report that your rights were violated but I doubt they will do anything.
I would need some additional information about the employer related question. If you are an at will employee then there is probably nothing you can do.
