I have joint custody of my 17 yr old son. Will be 18 in August. Order was placed in iowa, my son and i live in nebraska. Father has had no contact or visitation since I received physical custody 4 years ago. We didn't know where he was until recently when we found out he is in prison for 25 yrs for possession of meth with intend to distribute last month (April 2016). Can his rights be stripped and potentially adopted by my husband (this is something my son wants anyway) or can I get full custody?
Yes to the first. See a local lawyer to have the process started. The second, probably not because neither of those things makes him so bad that your child is better off without him at all, even for inheritance purposes. So the court will not strip his rights. Otherwise, you effectively already have full custody, so what is there to change?
