My wife has h1b and i 140 approved. i am h1 b visa holder. With the new law which gives h4 spouse work authorization, can I also get work authorization based on her visa if employers are not willing to sponsor H1b?
If you change your status to H-4 (I-539) then you may at the same time apply for an EAD (I-765) based on your H-4 application and her approved I-140. The EAD will allow you to work for any employer, so long as she maintains her H-1B status.
If you change your status to H-4, this is possible.
