We are looking into adopting a child from India. We are citizens of India currently in USA on H1B visa. Once we adopt the child, can we bring the child to USA on H4 (dependent visa)?
To meet the definition of child under the immigration act, the adopted child must first live with you for two years. Then you can bring the child to the U.s. as an H4.

You would have to live with the child for two years overseas before they could move to the US on an H-4 visa. For an H-1B visa holder, this is probably practically impossible. If you want to adopt from overseas, you will most likely need to get a green card first. It is MUCH easier to adopt from overseas if you are a citizen.
