I have a personal emergency and am working remotely since the last 3 weeks . I have one more week to go before which I will resume my work in-person . My boss is aware of the activities , mails and meetings that I have attended and I have documentation for the same . My boss came back to few days back that I will have to apply for leave for the 3 weeks as he cannot "justify" the work done .
Upon request , he is ok to consider 1 week of work-done if I continue working the remaining week . Essentially for 4 weeks of remote work-done , I will have to apply for leave for 3 weeks . He had not told indicated that remote work would not be considered, despite the fact that we interacted for work on a regular basis . I have mailed the HR department , please advise how I could handle this?
You asked this question before. If you are working, and they have asked you to work, and you are hourly, with some possible exceptions but they would have to be researched, you get paid for the hours. If they tell you to work and don't pay you, you likely can recover the money later. However, a lot depends on the exact wording of your conversations, how this came to be, whether you are in fact working the whole time and not leaving to care for a loved one during the day or handling your private matters during these hours. So it is a bit more complicated than the basic rule. If you are home to handle your personal things, and are not locked in to work for the full time, you could even be fired for asking for hours you didn't work fully. So take your facts to an employment lawyer for a consultation. It is a harder question to answer in general without knowing your facts.
