I have a debt in collection and open civil case regarding my debt. Collection lawyer could not served me with summon "because of the reason failed to find person X... or any information to allow further search". He came to the address that he has on file a few times but could not find me, because I do not live there physically. He talked to a person who live there now at that address and that person confirmed that he does NOT know me. Can default judgment be entered against me in that case or new summon of a complaint will be issued?
Service has to be accomplished for the case to move forward.
Just because I answer your question does not mean that I am your lawyer, or that you should take action based on my answer. I am not your lawyer. I can give you my best guess based on the facts as you present them in your question. Any questions that I ask in my response are rhetorical, which means that I do not want you to answer my questions.
Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals.
