My wifes grandma came down to see her daughter without her having any knowledge she then lied and said she was taking her shopping but never returned with her. We found out she had took her back home with her and my wifes mother. Two days after we got a surprise visit from cps. We didn't let her in but she tricked my wife by saying she needed to see the house anyways. At that time she informed us that they weren't taking her daughter from her they were only temporarily placing her with a family member. She gave us no option and said we had to do a safety plan if we wanted to get her daughter back. We denied consent to drug test since the allegations weren't for drug abuse or anything with drugs. We told her that we weren't going to do anything until we spoke to our lawyer. She then still forced my wife to sign the safety plan agreement even after we told her we weren't signing or doing anything without our lawyer. Her daughter was left with my wife's mother even after cps had knowledge of her mother having 7 prior cps cases. I am on the safety plan as well but I have yet to sign anything. None of this is even court order. So I don't understand what I can do.
CPS has authority to take possession of minors pending future hearings and decisions. They do not need warrants since this is not a criminal matter and nobody is being arrested.
