My brothers ex wife has accused him of sexually assulting his daughter ever since she remarried. CPS has investigated him and so have police for yrs and came up with negative results. She is at it again. He just spoke with the chief of police today. They advised him of his rights before questioning him. I personally think that the new husband is sexually assulting my niece and putting the blame on my brother in order to take the attention off of him. She only started with these accusations when she remarried. Can they get in trouble for these false allegations? What is the penalty? What can my brother do to put this to a stop? They are destroying his life.

Unless the new husband is a pedophile, it is unlikely he would sexually assault your niece to put your brother in jail. Your brother could file a civil suit, but I would strongly advise him to get legal advice from more than one attorney before proceeding down that path.
