My upcoming paycheck 10/12/18 was garnished by Capitol One. I have not received any notice. I looked up court records and they filed suit on 9/28/18. It states SUM & COMP filed 9/28/18.
Shouldn't I have had notice of the lawsuit and a chance to reconcile without garnishment?
If you are correct and they just filed suit against you on September 28 of this year, it is very unusual to have a garnishment. I have a feeling that the case was filed some time ago and you were simply unaware of it. You may wish to go to the court and look at the file to be sure. Good luck. If the case was just filed, you may need to contact an attorney.
