Ive been evicted for smoking in my apt im going to court to fight it.they wont take my rent payments but say their keeping security deposit for back rent
The landlord only has the right to deduct from your security deposit as provided by Civil Code Section 1950.5, but generally doesn't have to refund or account for the security deposit until after you move out.
I suggest that you focus your attention on fighting the eviction (preferably with the help of an attorney), and worry about the security deposit issue later.
