It's not clear from your question what the entity is here and what your relationship is. Is this a guardianship (of a living person) or the estate or trust of a deceased person. You've used all 3 terms here. They are not interchangeable. If there is "no probate" then there is no 'executor.' A person/entity has to be appointed by the probate court to be the executor.
