March 3, 200x divorce but division of property, assets was sent to mediation. April 1st he contacted OPM and discontinued the pay reduction that covered the survivor annuity he had placed me on.
He retired and elected the annuity years prior to our divorce. The reduction was discontinued April 1st. April 29th we went to mediation. He signed the agreement which provided for me to receive the survivor annuity. Three months ago I found out that he died March 2016. Today I found out that he had canceled the survivor annuity benefit prior to mediation settlement. Also, OPM is denying my claim for the benefits because the date of the divorce mediation consent court order is dated AFTER the date on the divorce decree. Additionally, I was told that if I still managed to get the OPM decision reversed
I will have to pay the premiums starting with April 2008 until present due to him not paying them. What is my recourse if I lose my case with regard to the actions my ex took and the court appointed mediation lawyer in NC?
This is far too complex for any lawyer to attempt to answer on an Internet forum. You need to gather up all the paperwork involved and take it to a consultation with a very experienced divorce attorney.
