I have a document expressly laying out the details of my job elimination. It appeared on my desk anonimously and I keep it to myself as I felt it was not for my eyes. Every item, over the course of several months, has been implemented. Then, I was fired but given no reason. Would it make a differenece as to reference checks--fired and not eligible for rehire versus job eliminated and eligible for rehire? Should there have been a severence package and the job elimination? Is this just greedy corporate America holding all the cards with "at will" employment?
At will employees can be fired for virtually any reason at any time. Severance packages are not required.
Disclaimer: Any information provided through this forum is meant merely for informational purposes and is not legal/medical/tax advice. No attorney-client relationship exists as a result of this communication and to establish such a relationship, a potential client must enter into a written contract with the attorney. This attorney has not agreed to handle your case, nor will he do so until you have signed a written retainer agreement which outlines the obligations of both parties.
Unless there was an individual employment contract or collective bargaining agreement (union contract), then termination and severance is at the employer's discretion.
Your employer may have simply changed course. Employers are allowed to do that because the needs of business will often require a flexibility and adaptation to changed circumstances.
Or, it could be, that your employer found out that you had obtained a confidential document and not done what the employer feels is the responsible thing -- to report that anonymous delivery.
You will never know what is at the bottom of this situation most likely, unless the employer's explanation comes out in a contested unemployment benefits hearing. By all means apply for UI benefits and appeal if you are denied.
My responses to questions on Avvo are never intended as legal advice and must not be relied upon as legal advice. I give legal advice only in the course of an attorney-client relationship. Exchange of information through Avvo's Questions forum does not establish an attorney-client relationship with me. That relationship is established only by individual consultation and execution of a written agreement for legal services.
Georgia is an "at will" state. Therefore you can be fired for no reason at the will of the employer.
