That is not the way to do it....you want to amend the papers of the appeal not try to start again
In California State Court, you cannot amend an appeal like you can in Federal Court. An appeal is taken from an order or a final judgment. If you appeal an order, you can re-appeal it as long as you are still within your jurisdictional time frame. If there are facts which were not presented to the lower Court, then it is unlikely to be allowed in on appeal absent special circumstances as to why it was not presented in the lower Court.
