A former employee was arrested for statutory rape. He was advised that the DA was requesting "first offender" on his plea deal. Along with time served on probation. He is having to register as a sex offender but my understanding was that the SOR was for life. But if he is on first offender would he be eligible to be taken off the SOR once he completes his probation and FO?
First, yes, first offender treatment is available on a statutory rape conviction. Second, yes, he would have to register while a first offender, but the registration would only be required while he was a first offender and, assuming successful completion, would not be required beyond that. You are correct, though, that most sex offenders are on the registry in Georgia for life, unless released by a court.
