Can my brother charge me for maintenance and all the repairs for our my parents home for the past three years, and then purchase the house for himself from the appraised price 3 years ago. If he decide to purchase the house for himself shouldn't it be for today appraisal and not 3 years ago from the day my parents passed away. Or if he purchases it for the appraisal price three years, can he legal charge me for the 3 year up keep for letting the home sit for 3 years unoccupied . And deduct all these fee from my portion of the estate.
Without reviewing the terms the trust, your questions cannot be thoroughly addressed. The trust may allow for your brother to purchase the home at the appraised price at a specified date and within a specified period of time - although that is unlikely. It appears that your brother is acting outside the scope of his duty as a trustee. You should hire to an attorney who practices estates and trusts law to review the trust and communicate with your brother to redirect his potentially fraudulent actions.
