A new company has taken over my apartment complex. They have added a Smoke Free amenities addendum that bans possession and use of tobacco products in common areas, amenities, areas outside the buildings and all outdoor spaces. There is a clause in the addendum that say "We have the right to terminate your Lease Contract or right of occupancy of the dwelling for any violation of this Smoke Free Addendum" and "Despite the termination of the Lease Contract or your occupancy, you will remain liable for rent through the end of the Lease Contract term or the date on which the dwelling is re-rented to a new occupant".
Is this a 'lease amendment' or is it some new 'community rules'. If it is an amendment, it is not effective unless you sign agreeing to it as a lease amendment, which you do not have to do unless it is part of the renewal of your lease AND you intend to stay there.
If it is a community rule, and the lease refers to community rules, then it is effective after reasonable notice (which you have) and you have to obey the rules.
Too many people smoke a cigarette and throw the butts anywhere; disgusting habit and a pain to clean up after. You may be paying a penalty for the lack of class of others.
