We had a student hit 3 times by another student in the stomach, leaving bruises. We have eye witnesses also. Our local police department says that the school can not press charges or file a complaint.
It is not the school's role to press charges with the police. The school handles school discipline. The student who got hit, along with his parents, is the one to file criminal charges with the police if he wants to.
Be aware that this response does not create an attorney/client relationship. I live and work in Massachusetts and may or may not know the local laws where you live. I hope people find my responses not only helpful but somewhat entertaining as well. If you rely on this as legal advice, remember the old saying, "You get what you pay for."
