My ex-wife applied for and is receiving Medicaid and food stamps for our son. As a condition of receiving that, I was told that a child support case had to be opened against me. My understanding is that the Florida Department of Revenue's case can be closed if all Medicaid and food stamps provided to date are paid back. Is this correct? If not, and the case moves forward, then can the monthly support determined through the calculator be challenged/negotiated?
The DOR's child support case is unlikely to be closed until the children are receiving the proper amount of child support they are entitled to receive from both parents. Through the discovery process you can be required to provide them with proof of your income. Child support is calculated based upon both parents' gross income, health insurance costs (if any), day care costs and overnight timesharing with each parent.
