In state of WA can a psychologist deny to give copy of chart notes or (process notes) to patient?
I was told by my lawyer to go to psychologist and I got a copy of report from psychologist and I saw several significant errors so I wanted to see intake form as well as chart notes based on which psychologist made that report....so I can see how he made those errors. English is not my first language that is why he must have misunderstood me but he is giving hard time to give me my own chart notes as well as intake form...He and his office ignoring my request ...what can I do?
Keep in mind that I absolutely do not pretend to be an expert in this field, but want to provide you a step in the right direction since no one else has stepped in to answer. However, upon conducting some very basic research, it looks like a psycholgoist (qualified as a mental health services pursuant to RCW 70.02.010) can deny access to patient records for reasons pursuant to RCW 70.02.090 (http://app.leg.wa.gov/rcw/default.aspx?Cite=70.02&full=true#70.02.090). Please review the statute (or have your own lawyer review it) and either directly consult with a lawyer or simply accept that the psychologist might believe he/she is doing this in your best interest. There may be other applicable laws or reasons, so please do not take this as a definitive answer, but merely a start in the right direction.
