I'm don't think it would make a difference. The right of survivorship in a deed is only relevant if one of the title owners passes away. Since you were awarded a percentage of ownership then a new deed will be recorded and the old deed becomes irrelevant. Furthermore, if you were a title owner of the property then there is no fraud since you had access to the information on the deed just as much as your spouse.
Based upon the facts as presented, my answer is no.
