My husband is on probation for petty property crimes due to substance use struggles, we are legally married, coming up on 2 years(together 9). I have my own past criminal history but have not been on paper for almost 4 years. His probation officer threatened a no contact between us until she realized we were legally married, and is now forcing him to live elsewhere instead of with us, his family. Her reasoning is that she believes I am a factor in his relapses regardless of the fact that there is zero proof of this. I have had a great job for 5+ years, I am in ongoing treatment voluntarily, and I live in a beautiful well maintained, brand new clean apartment. She says if one partner is using then the other one is too. Can she do this? Since we are one entity in the eyes of the law I have heard that she cannot separate us. Like i said above too there is ZERO history of violence between us.
This is not an immigration question. I have moved it to criminal in hope that you will receive an answer.
