The PO expressed his desire to early release the probationer except for the monthly restitution payments. Does he have the jurisdiction to change supervised probation to an unsupervised probation as long as the payments to the court keep coming in and there are no violations? Or if he does not have that jurisdiction couldn't he request to the Judge that the conditions be amended to exclude the monthly in-person visit to his office in lieu of say, calling in by telephone or checking in every other month? Just how much jurisdiction does a PO have?
The PO does not have the power to modify a sencetne from formal to informal probation. This can be requested of the judge.
