Can a prison sentence be reduced for good behavior even if it’s because you chose prison over probation?
Donestic assault and violation of a restraining order as a result. He got 5 yr probation and has done 1 yr. he hates it and chose to do the time instead. He has a felony charge from over 20 yrs ago, and I believe this charge is a felony too. Can the sentence be reduced for good behavior?

All Minnesota executed jail and prison time qualifies for one-third "good time" reduction. The jail or prison can administrative take away "good time" for violation of disciplinary policies. the fact that an inmate chose an executed sentence (incarceration) instead of probation makes no difference; when it comes to good time reductions. Minnesota DOC will follow the judge's sentence, which includes the one-third "good time" reduction. The time gets added on as supervised release, after prison.
