My neighbor slapped me across the face some time ago, and she happens to be the chair of the garden committee of the coop building where we live. I didn't retaliate but immediately called the police. They took a statement, and went to talk to her the night of the incident, however her name does not appear on the report. I wrote a petition to be signed by the tenants to ask her to step down. Someone suggested it might be defamation. Is that the case?
Depends what it says
A petition itself is not defamatory
If you charge her with something it must be absolutely truthful otherwise it could cross the line
Mr. Larson is correct. Whether they speak poorly of a person or not, statements are only defamatory if they are false.
