My neighbor has a fence in disrepair installed 1 foot from the property line. The township has an ordinance on fences but refuse to enforce it. The bad side of the fence is on my side and the fence is falling down and each eight foot length is either falling in or out.
The answer to your question is, generally, "yes", the township has the discretion to "pick its battles", so to speak. Of course, it cannot do so in a discriminatory manner against a protected class (i.e., based on race, religion sex, disability).
