My step sons mother neglected him 2 years ago, has hardly see him or has even talked to him. She has a history of drug use, and she has been in trouble with the law and they haven't sent her to a mental hospital at least 6 or 7 in the past year? Well my husband just recently filed for child support we haven't went to court yet but she is threatening to request a drug test against him, is this possible? Of course he would pass but I am just curious she is the one of history with drugs and the law in the past and she is the one that neglected her son. But she is trying to cause problems just so she don't have to pay??
If it's a State child support hearing, it is unlikely that the court will order a drug test just because the non-custodial parent shows up and requests one. If custody is at issue, though, and either parent requests a drug screen, then the court is likely to order both parents (and live-in partners or spouses in many cases) to be tested.
