In Westchester County, the DA's office usually does not make an offer on a DWI refusal, meaning that you either plea guilty to the DWI charge, or fight the case to trial. A negative TASC report can change the judge's sentence on the case, or cause a judge to consider revoking your release, and setting bail, because you are not cooperating with a condition of the court. Make sure your attorney knows how to handle a DWI refusal case, because it sounds like you may need to fight this in order to avoid a criminal conviction.

A negative report can surely negatively impact your matter in terms of sentencing if you plead guilty or are found guilty after a trial. If the DA's Office is not making an offer on your case and you state that "you can't take a DWI", be prepared to push the matter to trial.
