On 12/05/18 my car was totaled at an intersection (my cars driver was not at fault). The car had PLPD and I am the only listed driver but I was not driving nor was I a passenger when it happened. My bf took it to stop at the bank. We are mid-process of a mini tort claim that was started not too long after the accident and it has been about 3 months already. My insurance company says the other party’s insurance doesn’t want to pay the mini tort since the driver(my bf) was not insured. I know Michigan is a “no fault” state, which makes it stressful when things like this happen and a vehicle is lost completely without anything to cover damages. Will receiving a mini tort payment for me be likely in this situation or does the other party have a better case for fighting it?
