Can a man that had sex with a women in Seattle prevent the mother from giving birth in Hawaii? The mother wants the courts in Hawaii to have legal jurisdiction over child custody and paternity, while the courts in Seattle have jurisdiction over child support. If the father is not able to travel to Hawaii he will never know his daughter, is this legal?
The home state is where the child has lived with a parent, or a person acting as a parent, for six consecutive months. The six months must come immediately before the start of the child custody case. For children younger than 6 months, the home state is the state they have lived in since birth.
Short answer is "No". Individuals, pregnant or not, have a constitutional right to travel. The father will have to make some decisions as to whether he will relocate to Hawaii or seek a plan that can be accomplished with long distance transportation. Such plans are common in situations where the parents do not live in close proximity.
I don't believe there is a law that can allow a putative father to be allowed to restrict a pregnant mother.
If there were it would be quite unreasonable. As attorney Gibbs dictated, the woman's right to travel and where she resides is her choice and the father will need to institute proceedings where the child lives.
