1 family house, 2 rental units, 1 is illegal.
Illegal unit recently inspected by DOB, pics taken, court date for eviction this week.
Fire in basement of the unit that is legal, both units affected. DOB posted notice "unfit for occupancy".
Fire just occurred this Sat, no determination of how fire started, etc at this time.
Neither tenant had renters insurance.
Can the LL be held responsible for any loss in any manner, since his illegal action ultimately led to the loss ?
how and where would a tenant begin the process ? does this fall under LL / tenant ?
How did the illegal apartment result in the fire in the illegal apartment? I don't see a case against the landlord unless the landlord had notice of a defective condition that caused the fire. I don't see lost wages as a damage if there is a case.
