Sold a car and did everything I had to do with the release of liability. New owner never registered. Car got towed (with new owner). Towing company threaten us with legal action even thou we showed them proof of DMV. Now receiving letters from there lawyer saying that will take our driver license and send us to collections and small claims court is we don’t pay.
The lawyer can threaten, but if you did everything required under the sale (title and release) then you are no longer liable. The lawyer CAN sue, but you would beat the case and probably be able to counter-sue.
Attorneys can act as debt collectors. However, they must act within the bounds of the law. An attorney cannot make false assertions in an attempt to get you to pay.
