Landlords lawyer gave a 10 or evict note. After 14 days lawyer sends a letter saying tenant needs to move out in 48hrs. Tenants have not been served or been to court in front of a judge. Lawyer states cannot speak to tenant because it’s now a criminal case. Landlord has repeatedly called and threaten to call police to home prior to and during the 10 day evict notice. Is this legal? How will the tenant know if there really is a judgement to evict?
You need to contact a local landlord tenant attorney with the specific details. In general, you can't be evicted without being served a summons for summary ejectment and provided a court date. Make sure that you keep an eye on the entire property, service can be accomplished by the sheriff posting notices on the door.
