Our former landlord is attempting to withhold our Security Deposit. They sent a Notice which included charges for items that are normal wear and tear, and for cleaning costs that seemed excessive. I found estimates for comparable services for what they claimed was needed for cleaning and their costs were almost double. They did update their claim, but now they are demanding that we accept the new offer or they'll go to court.
That's the way it works with deposit disputes; both parties must be sure to follow all of the statutory protocols - and then if there's a dispute, they go to court, present whatever evidence they each have, and the court decides. Prevailing party gets legal fees and costs paid by the loser, an amount that is bound to be far, far more than the deposit; so one has to e pretty sure they wil win, and should be sure to consult with a good local tenants lawyer before proceeding.
Hope this helps.

They are NOT intended as legal advice, nor to be relied upon by anyone, for any reason, nor to create an attorney-client relationship between you and I; and all askers should consult an attorney for advice regarding each individual matter, since each case is a bit different, and not all information is typically recited in the online question as posted. PLEASE do not contact me directly; I am NOT accepting new clients at this time, and only volunteer here on AVVO to "give back" after a long and prosperous career. Good luck!
Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals.
