I pay most of my rent by the 1-5 of the month and its not late until the 6 but sometimes I’m a few days or a week late for some of it but it’s always paid. He is threatening me to terminate my lease due to late payments can he do that even though I always pay?
There is nothing in the WA Residential Landlord-Tenant Act that allows the tenant to be habitually late with rent. Paying rent on time is the first duty of the tenant listed in the RLTA. So, yes, a landlord can end the tenancy when the tenant is habitually late with rent.
The landlord would need to go through the statutory procedures to end the tenancy.
The RLTA does authorize a tenant whose lease has not ended to restore the tenancy by paying all the rent due, the late fees authorized by the rental agreement, and the landlord's attorney's fees.
The simpler solution for you likely is to stop being late with rent. Your landlord is likely depending on the rent payment to pay the landlord's bills. You being late likely is bad for the landlord's finances.
I agree with the previous answer. You rent is due on the first and late on the second. Any grace period is only a courtesy and late fees start after the grace period. Yes the lease can be breached by paying late, even once. So start paying early or think about moving.
