My apartment complex has been under construction for several months. They are replacing decks and so they had to take away access to my bottom floor patio and access to our storage. I pay rent that includes that space so I requested compensation and they refused saying that the Fair Housing laws prevent them from compensating me. I would like to know if this is something I can take them to small claims court over?
You can sue them for breach of the lease and reduction in value see RCW 59.18.110. Fair Housing has no effect as far as I can tell.
