Tenet signed a lease in May for a one bedroom. Tenet has two children listed on the lease both under 5. Tenet was 8 months pregnant at the time she signed the lease. Now the landlord is telling the tenet she has to rent a two bedroom b/c heartbeats exceed the number allowable in a one bedroom. Is the landlord legally able to evict tenet if she decides to not rent a 2 bedroom until her lease is up?
This is a building code issue and if thats the rule then yes and you also need to be aware that these issues can arise to create DCF issues also.
