For almost a year the water has been leaking through the ceiling into the electrical fixtures in the main level. The renter made several attempts to get the leaks and electrical issues fixed. They also had to supplement electric space heaters due to the fact that the heat only worked on one side of a very large old drafty farmhouse. They also made several attempts to get them to fix that with no success. The Family of 7 lost everything and the Handicapped Grandmother barely made it out. The even lost some of the family pets. The only thing that wasn't a complete loss were 3 kids bicycles and 3 half melted four wheelers. The Landlord has been uncooperative and has locked up those items and said that they are also keeping the $800 security Deposit. Please Help
I'd start by making a complaint to the Wisconsin Department of Agriculture, Trade, and Consumer Protection. They investigate a number of landlord/tenant disputes to determine if a party is in violation of Wisconsin law. You can start the complaint process by filling out this form:
If the damages are less than $10,000 and you can prove the fire was caused by the landlord's negligence you could take this matter into small claims court, The Wisconsin Administrative Code ATCP 134.06(2) provides that the landlord must account for amounts withheld from a security deposit in writing within a limited time period or face penalties. If you have greater damages, a circuit court action could be commenced. The landlord's property insurance carrier my also be an appropriate party.
