50-year-old son died estranged from his father since an early age. Mother and father divorced when he was 13. He was physically verbally and emotionally abused by his father from age 3. Blacked his eye and face at 4. Father paid child support but was no father even thru adulthood. Probate attorney says father gets 50% of accident lawsuit even though he was a bad father.
There is SC law which allows a Petition to exclude a parent for failing to support. Your facts indicate financial support was provided but was it sufficient? Failure to support is the only avenue to reduce a parent’s inheritance from their child. Sadly, being abusive does not exclude someone from inheritance rights - if it did there would also be a lot of children receiving nothing due to the elder abuse towards their parent.
