Charged with a misdemeanor, the municipal code says it can only be a infraction or misdemeanor. I have 1 prior( nothing related to the current charge) for a non violent non series crime. Thank you

More information is needed, but by initial take is no. For example, disturbing the peace (Penal Code section 415) cannot be charged as a felony. There is no such thing as felony disturbing the peace.
